DUTY OF PUBLIC OFFICER TO WHOM A GRATIFICATION IS GIVEN OR OFFERED

 

Offence under Section 16 of Prevention of Corruption Act (Chap 131)

It is the obligation of Government employees who were given, or offered any bribe or to report the act as soon as possible to the Anti Corruption Bureau.

Failure to do so without reasonable excuse: -

Fine of BND$500 and imprisonment for 6 months.

 

PROTECTION OF INFORMERS

Section 30 of Prevention of Corruption Act (Chap 131)

The public should not be afraid to help combat corruption. ACB will always ensure the confidentiality of the information provided and WHISTLEBLOWER is protected and cannot be disclosed to any party under any circumstances.

None of the witnesses are allowed during the trial to disclose the name or address of any informer or state things that may reveal the identity of the informant to be identified,

Any document or evidence used at trial contains the identity of the informant shall not be disclosed because it would led to the identity of the informant.

If the allegations were untrue and false information was given, the Court may direct that the original report to be revealed during the trial, including the identity of the informer.

OFFENCE OF MAKING FALSE REPORT OF THE COMMISSION OF OFFENCE

 

OFFENCES UNDER SECTION 34 OF PREVENTION OF CORRUPTION ACT (CHAPTER 131)

Any person who, under the course of an investigation into, or in any proceedings relating to, an offence alleged or suspected to have been committed under this Act, knowingly-

  1. Makes or causes to be made a false report of the commission of an offence under this Act to the Director, Deputy Director or any Officer of the Bureau;
  2. Misleads the Director, Deputy Director or any Officer of the Bureau.

Shall be guilty of an offence and shall be liable on summary conviction to a fine of $20,000 and to imprisonment for one year.
