The High Court Bandar Seri Begawan passed a sentence against one Dayang Hajah Latifah binti Haji Junaidi, a former Brunei Shell Petroleum (BSP) personnel who held the position of Stock Analyst Buyer in the Supply Chain Management (SCM) Department. On 2nd May 2017, the Defendant had pleaded guilty to 35 charges under section 6(a) of the Prevention of Corruption Act (Chapter 131) read with section 7(1) of the Prevention of Corruption Act, Chapter 131. The Defendant also agreed for the other 67 charges under section 6(a) to be taken into consideration for the purposes of sentencing. Hajah Latifah binti Haji Junaidi decided not to proceed with the trial which was initially set to begin on 1st May 2017 and instead pleaded guilty to all charges before the Honourable Judicial Commissioner Gareth Lugar-Mawson.
Investigation conducted by the Anti-Corruption Bureau (ACB) revealed that between October 2005 and January 2009, the Defendant had corruptly received gratifications in the amount of BND$51,408.00 (Brunei Dollars Fifty One Thousand and Four Hundred and Eight) from Steve Liew, a Salesman at Musfada Enterprise, a BSP-approved contractor, as a reward for issuing Purchase Orders for various types of emergency safety equipments for BSP to which the purchases were part of the contract with BSP.
The Honourable Judicial Commissioner Gareth Lugar-Mawson sentenced the defendant to three (3) years and eight (8) months imprisonment for each of the 35 charges, which is to be served concurrently. The Court also ordered for the defendant to pay a penalty under Section 17 of the Prevention of Corruption Act of BND$36,073.00 (Brunei Dollars Thirty Six Thousand and Seventy Three) within 6 months from today and in default of payment, to serve 6 months’ of imprisonment which is to be served consecutively. The Defendant is also to pay the prosecution costs of BND$75,000.00 (Brunei Dollars Seventy Five Thousand) within 3 months from today and in default of payment, to serve an additional 3 months’ imprisonment consecutively. The defendant’s imprisonment sentence takes effect from 2nd May 2017.
